Terms of service

These terms govern your use of Strata, operated by Modulus1 ("we", "us"), a software business owned and operated by Adam Aera Daffa Aldrich. By creating an account you agree to them. Enterprise customers may have a separate master agreement that supersedes these terms.

1. Accounts

You must be at least 18 years old and able to enter a legally binding contract to create an account. You are responsible for keeping your credentials safe and for all activity that occurs under your account. If you suspect unauthorized access, notify us immediately.

2. Acceptable use

You may use Strata only for lawful purposes and in accordance with these terms. You agree not to: (a) use Strata to attack or harm third-party systems; (b) circumvent the rate limits or robots.txt of sites we crawl on your behalf; (c) resell or sublicense access without written consent; (d) reverse-engineer any part of the platform; or (e) violate applicable law or regulation.

3. Subscription and billing

Subscription fees are billed in advance, monthly or annually as selected. Annual plans are non-refundable mid-cycle except where required by law. Overages (if applicable) are billed at list rates at the end of the billing period. We reserve the right to suspend access for non-payment after reasonable notice.

4. Presale lifetime discount

Presale subscribers receive a lifetime discount as described in the Presale Terms addendum. The discount is personal and non-transferable. See /legal/presale-terms for full terms.

5. Intellectual property

Modulus1 retains all rights to the Strata platform, trademarks, and underlying technology. You retain all rights to your data. By uploading content, you grant us a limited license to process it solely to provide the service.

6. Service levels

Enterprise plans include a 99.95% uptime SLA with service credits for covered incidents. Starter and Pro plans target 99.9% availability but without financial SLA. See the Enterprise addendum for credit schedules.

7. Limitation of liability

To the fullest extent permitted by applicable law, Modulus1's aggregate liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

8. Indemnification

You agree to indemnify and hold harmless Modulus1 from any claims, losses, or damages arising from your use of Strata in violation of these terms.

9. Termination

Either party may terminate at any time. Upon termination, your access ceases and your data will be retained for 30 days before deletion, during which you may export it. We may terminate immediately for material breach of these terms.

10. Governing law

These terms are governed by applicable law in the jurisdiction where Modulus1 operates. Any disputes shall be resolved through binding arbitration or the appropriate courts of competent jurisdiction.

11. Changes to these terms

We may update these terms from time to time. Material changes will be notified at least 30 days in advance by email to your registered address. Continued use after the effective date constitutes acceptance.
